Regulamin świadczenia usług drogą elektroniczną
w domenie www.eGazety.pl
należącej do eGazety Sp. z o.o. z siedzibą w Warszawie
  1. These rules and regulations set forth the principles for performing the service of providing users with access to digital versions of press titles through electronic means.
  2. Terms present in these rules and regulations shall have the following meanings:
    1. Services – services of providing Users with access to electronic versions of press titles listed in the offer of eGazety,s over the Internet.
    2. eGazety – eGazety Sp. z o.o., having its registered office at the following address: Warszawa (00-838), ul. Prosta 51, entered into the National Court Register kept by the District Court for the city of Warsaw, XII Commercial Division under the number KRS 0000142872, amount of share capital: PLN 50,000, tax identification number NIP 521-11-95-612, owner of the www.egazety.pl domain, the entity providing the Services,
    3. User - a natural person, legal entity or an organizational unit without a legal personality that acts in law, recipient of the Services
    4. Website – internet web pages in the www.egazety.pl domain whose purpose is to conclude and perform contracts for providing of the Services
  3. Within the scope of the Services, eGazety shall provide the User with access to electronic versions of press titles listed in the eGazety offer, the contents of these electronic versions shall be identical as of the printed versions or enhanced with thematic, promotional or advertising extras. eGazety reserves that the electronic versions of press titles may lack the following:
    1. advertising inserts,
    2. promotional extras (CDs, books, maps, guides etc.),
    3. other thematic extras,
  4. The following conditions are required in order for taking advantage of the Services to be possible:
    1. 512 kbps or faster Internet connection
    2. Internet Explorer, Mozilla Firefox or Opera browser software installed
    3. Operating system: Windows XP, Windows 2000,
    4. RAM memory: 512 MB of (or more)
    5. vailable hard disk space: at least 128 MB, *the amount of free disk space required is associated with the number of downloaded e-editions. One edition of an e-newspaper occupies between 5 and 15 MB (mega bytes) of space on the hard disk.
  5. The contract for providing the Services is entered into by means of the User accepting the eGazety offer listed on the website. The eGazety offer shall be binding for eGazety as long as it remains listed on the website.
  6. The acceptance of the eGazety offer is done by means of registering with the website as a User, submitting an order for a selected press title and making a payment according the eGazety price list.
  7. eGazety przesyłają Użytkownikowi pocztą elektroniczną potwierdzenie złożenia zamówienia na dostęp do wybranego tytułu prasowego.
  8. After the contract for providing the Services has been Concluded, eGazety sends the User, by e-mail, a confirmation of conclusion of the contract, in the form of a printable certificate with an electronically reproduced signature of a representative of eGazety. The certificate states all major provisions of the contract for the providing of the Services.
  9. The following methods of payment are available:
    1. by wire transfer from the User’s bank account
    2. with the User’s credit card by means of the eCard SA internet service implemented into the website.
    3. by postal order
  10. Contracts for providing the Services are concluded for a specified time, according to the eGazety offer and to the choice of the User.
  11. Upon accepting the eGazety offer, the User is obliged to read these rules and regulations and to provide factual personal data when registering with the website.
  12. By accepting the eGazety offer, the User declares his accord for providing of the Services to be commenced immediately after the contract for providing of these services has been concluded.
  13. The User is not entitled to withdraw from the contract for providing the Services, as stated in Art.7 of the Act of 2 March 2000 on the protection of some consumer rights and the responsibility for the damage made by a dangerous product, under Art. 10 item 3, points 1,5 and six thereof.
  14. eGazety shall undertake to apply due diligence in order to achieve, with the use of the available computer tools, the relatively highest quality of the electronic versions of the press titles offered. However, eGazety reserves that the conversion of material to digital form may cause the deterioration – in comparison to the printed version – of the quality of some graphics present in the press titles provided within the scope of the Service.
  15. One instance of purchasing access to a digital version of a given press title entitles the User to download from eGazety servers any issue of this press title (be it the current issue or one any of the archival issues) up to three times, with the reservation that the material can be accessed from no more than one terminal at a time. A download shall mean each instance when downloading is commenced and followed by the obtaining of at least 60% of the volume of a given digital version of a press title.
  16. Each consecutive download of a digital issue of a given title will block the access to the same digital issue of a press title downloaded previously. In the case of alternate use of different computers, each consecutive download of a digital issue of a given title will block the access to the same digital issue of a press title downloaded previously. The behaviour described above results in the lack of possibility of archiving issues.
  17. The contract for providing the Services entitles the User to download from the website computer software allowing to download and browse digital versions of press titles, while eGazety simultaneously grants to the User a license to use the said software for the following purposes:
    1. downloading it from the eGazety website;
    2. saving the software on hard disks of the User's computers,
    3. using the software for the sole purpose of downloading and viewing digital versions of press titles, pursuant to the contract for providing the Services
  18. Remuneration for the granting the license for usage of the software is included in the remuneration due to eGazety for providing the Services.
  19. eGazety reserves the right to withdraw individual press titles from its offer. In such cases, the contract for providing the Service in the scope of a press title that has been withdrawn from the offer shall be terminated in the period following the withdrawal of this title. Remuneration paid to eGazety by the User for the access to digital versions of a press title in the period following the withdrawal of this title from the offer shall be subject to reimbursement pursuant to the effective provisions of law.
  20. The User is entitled to lodge complaints against the Services provided by eGazety by means of sending the matter of these complaints to the editorial office at the following e-mail address: egazety@egazety.pl, or with a registered letter to the address of the registered office. The complaint shall be investigated and the User shall receive information on the decision within 14 days from the date of submission.
  21. Personal data of the User will be processed by eGazety within the scope allowed by the provisions of law and falling under the consent by the User expressed upon their registration with the website. The User is entitled to inspect their personal data, amend them and request it ceased to be used. Inspection and amendment of the personal data of the User is available through the website.
  22. The contract for providing the Services may be drawn up and concluded only in the Polish language.
  23. The User shall not be entitled to benefit from the copyrights to the work comprising the digital versions of press titles in a scope exceeding the permitted use of protected works, as specified by the provisions of the Copyright and Neighbouring Rights Act of 4 February 1994.
  24. Any conflicts that may arise between eGazety and Users without consumer status in relation to the Service, shall be settled by the general court with jurisdiction over the registered office of eGazety.
  25. In relations between eGazety and users without entrepreneur status , provisions of Art. 661 § 1 and 2 of the Civil Code shall not be applicable.
  26. These rules and regulations shall constitute a part and parcel of the offer of eGazty for providing the Services.
  27. These rules and regulations shall become effective as of 14.04.2008.
